These Terms of Service ("Terms") govern all services provided by Flourishstar Logistics Air & Sea Cargo ("Flourishstar Logistics", "we", "our", or "us"). By booking, sending, or receiving a shipment with us, you agree to be legally bound by these Terms.
Definitions
- "Shipment": Any package, parcel, or cargo accepted by us for transportation
- "Customer" / "You": The sender, receiver, or any party with an interest in the shipment
- "Services": Logistics, freight forwarding, air and sea cargo services provided by us
Scope of Services
We provide international logistics services between Ghana, the United Kingdom, and the United States, including:
- Freight forwarding (air and sea)
- Cargo consolidation and handling
- Delivery coordination
- Customs facilitation (as agent only)
We act as a logistics provider and may engage third-party carriers.
Acceptance of Shipments
We reserve the right to:
- Refuse any shipment without explanation
- Open and inspect shipments for security or compliance
- Verify contents for customs or regulatory purposes
Acceptance of a shipment does not guarantee delivery.
Customer Obligations
You warrant that:
- All information provided is accurate and complete
- Shipments are properly packaged and labelled
- Contents comply with all applicable laws and regulations
- You have the legal right to send the goods
You agree to indemnify Flourishstar Logistics against any claims arising from your breach of these obligations.
Prohibited and Restricted Goods
You Must Not Ship:
- Illegal goods or controlled substances
- Dangerous or hazardous materials (unless declared and approved)
- Weapons, explosives, or ammunition
- Counterfeit or stolen goods
- Any items prohibited by UK, Ghanaian, or US law
If such goods are discovered, we may:
- Refuse or stop shipment
- Dispose of or surrender goods to authorities
- Recover costs from you
Charges and Payment
- All charges must be paid in full before dispatch unless agreed otherwise
- Charges may include freight fees, handling, customs duties, storage, and taxes
- We reserve the right to apply additional charges if shipment details were inaccurate
- Late payments may incur penalties or delays
Customs Clearance
You appoint us as your agent for customs purposes.
You are responsible for:
- Providing accurate documentation
- Paying duties, taxes, and clearance fees
- Compliance with import/export laws
We are not liable for customs delays, inspections, or seizures.
Delivery and Transit
- Delivery times are estimates only and not guaranteed
- We are not liable for delays caused by third parties or external factors
- Delivery may be made to the address provided without signature unless specified
Risk of Loss
Risk transfers:
- Upon collection (for outbound shipments), or
- Upon delivery (for inbound shipments), depending on service type
We are not liable for loss due to:
- Poor packaging
- Inherent defect of goods
- Customs seizure
Limitation of Liability
To the maximum extent permitted by law:
- Our liability for loss or damage is limited to the declared value or a standard compensation cap, whichever is lower
- We are not liable for:
- Indirect or consequential loss
- Loss of profit, business, or opportunity
- Delays or service interruptions
Insurance
- Insurance is optional and must be requested before shipment
- Without insurance, compensation is limited
- Claims require proof of value and evidence of loss/damage
Claims Procedure
- Claims must be submitted within 7–14 days of delivery or expected delivery
- Claims must include supporting documentation (receipts, photos, tracking details)
- Late or incomplete claims may be rejected
Storage and Abandoned Goods
If a shipment is:
- Undeliverable, or
- Not collected within a reasonable time
We may:
- Charge storage fees
- Return shipment at your cost
- Dispose of goods after reasonable notice
Right of Lien
We reserve the right to retain possession of shipments until all outstanding charges are paid.
Cancellations and Refunds
- Cancellation is only permitted before dispatch
- Refunds may be subject to deductions for administrative and incurred costs
- No refunds once shipment is in transit
Force Majeure
We are not responsible for delays or failures caused by events beyond our control, including:
- Natural disasters
- War, terrorism, or civil unrest
- Government actions or customs delays
- Strikes or transportation disruptions
Third-Party Services
We may use third-party carriers and agents. We are not responsible for their acts or omissions, but we will make reasonable efforts to ensure service quality.
Data Protection
We process personal data in accordance with applicable data protection laws, including UK GDPR. Please refer to our Privacy Policy for details.
Website Use
If you use our website:
- You agree not to misuse or attempt to disrupt the service
- All content is owned by Flourishstar Logistics and may not be copied without permission
Indemnity
You agree to indemnify and hold harmless Flourishstar Logistics from any claims, damages, fines, or expenses arising from:
- Breach of these Terms
- Shipment of prohibited goods
- Violation of laws or regulations
Severability
If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
